I. General Provisions

The Privacy Policy specifies how personal data of Users necessary for providing electronic services via the website www.maxsoft.pl is collected, processed, and stored.

The website collects only personal data necessary for providing and developing the services offered within it.

Personal data collected via the Website is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter GDPR) and the Personal Data Protection Act of 10 May 2018.

III. Purpose of Personal Data Collection

Personal data is used for the purpose of:

• account registration and user identity verification,
• enabling login to the Website,
• performance of the contract regarding services and e-services,
• communication with the User (phone, contact form, etc.),
• sending a newsletter (after the User consents to receiving it),
• operating the comment system,
• providing social services,
• promoting the Controller's offer,
• marketing, remarketing, and affiliate activities,
• personalizing the Website for Users,
• analytical and statistical activities,
• debt collection,
• establishing, pursuing, or defending against claims.

Providing data is voluntary but necessary to conclude a contract or use other functionalities of the Website.

IV. Types of Processed Personal Data

The Controller may process the User's personal data: first and last name, date of birth, residential address, email address, phone number, NIP.

V. Period of Personal Data Processing

Users' personal data will be processed for the period:

• when the basis for processing is the performance of a contract - until the statute of limitations for claims after its performance,
• when the basis for processing is consent - until its withdrawal, and after withdrawal of consent until the statute of limitations for claims.

In both cases, the statute of limitations period is 6 years, and for periodic claims and claims related to business activities - 3 years (unless otherwise provided by special regulations).

VI. Sharing of Personal Data

Users' personal data may be disclosed to: entities affiliated with the Controller, its subcontractors, entities cooperating with the Controller, e.g. companies handling e-payments, courier/postal service providers, law firms.

Users' personal data will not be transferred outside the European Economic Area (EEA).

VII. Users' Rights

The Website User has the right to: access to the content of their personal data, their rectification, erasure, restriction of processing, data portability, object to processing, withdraw consent at any time (which does not affect the lawfulness of processing based on consent before its withdrawal).

The Controller shall fulfill or refuse to fulfill the request immediately - no later than within one month of receiving it.

The User has the right to lodge a complaint with the President of the Personal Data Protection Office if they consider that the processing violates their rights and freedoms (GDPR).

VIII. Automated Decision-Making and Profiling

Users' data cannot be processed in an automated manner resulting in any decisions being made against them.

Users' data may be profiled for the purpose of customizing content and personalizing offers after obtaining their consent.

IX. Final Provisions

The Controller reserves the right to amend the Privacy Policy, provided that Users' rights are not restricted.

Information about introduced changes will appear in the form of a notice available on the Website.

In matters not regulated in this Privacy Policy, the provisions of the GDPR and Polish law shall apply.
